Terms of Service

These Terms of Service (“Terms”) govern your access to and use of OpenSeason, including the website at openseason.life, applications, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
OpenSeason is an early product. These Terms are a standard template for a consumer SaaS product and are not a substitute for advice from your own lawyer. If you do not agree, do not use the Service.
1. The Service
OpenSeason helps you capture life signals, organize Areas, Goals, and tasks, prioritize work in Focus, and interact with an AI coach. Features may change as we improve the product. We may add, modify, or remove functionality with or without notice.
2. Accounts
- You must provide accurate registration information and keep it updated.
- You are responsible for activity under your account and for keeping credentials secure.
- You must be at least 16 years old (or the age of digital consent in your region).
- One person per account unless we offer organization plans later.
3. Acceptable use
You agree not to:
- Use the Service for illegal, harmful, or abusive purposes
- Attempt to access other users’ data or disrupt the Service
- Reverse engineer, scrape, or overload our systems beyond normal use
- Misuse AI features to generate unlawful content or to evade rate limits
- Resell or sublicense the Service without our written permission
We may suspend or terminate accounts that violate these rules.
4. Your content
You retain ownership of the text and structure you create in OpenSeason (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service (including running AI models you invoke).
You represent that you have the rights needed to submit Your Content and that it does not infringe others’ rights.
5. AI features
- Coach and extraction features send prompts and relevant context to third-party model providers (for example Anthropic or OpenAI) under our configuration.
- AI output can be wrong, incomplete, or inappropriate. You are responsible for reviewing suggestions before acting on them in the real world.
- OpenSeason is not medical, legal, financial, or therapeutic advice. For professional decisions, consult a qualified human professional.
- Usage may be subject to plan limits (monthly interactions, hourly burst limits, and optional overage). Limits are described on the site and in Settings.
6. Plans, billing, and refunds
- Free and paid plans may offer different interaction caps and features. Prices are shown at signup or in Settings and may change with notice for future billing periods.
- Paid subscriptions renew until canceled. You can cancel for the next period according to the billing provider flow we support.
- Except where required by law, fees are non-refundable. If we discontinue the Service, we may provide a pro‑rata credit or refund for unused prepaid periods at our discretion.
7. Privacy
Our collection and use of personal data is described in the Privacy Policy. By using the Service, you also acknowledge that policy.
8. Intellectual property
The Service, branding, and software (excluding Your Content) are owned by OpenSeason or its licensors. These Terms do not transfer ownership of our IP to you.
9. Availability and changes
We aim for reliability but do not guarantee uninterrupted or error-free service. We may perform maintenance, enforce rate limits, or temporarily suspend access for security or operational reasons.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENSEASON AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
12. Indemnity
You will defend and indemnify OpenSeason against claims arising from Your Content or your misuse of the Service, to the extent permitted by law.
13. Termination
You may stop using the Service and delete your account in Settings (where available). We may suspend or terminate access if you violate these Terms or if we shut down the Service. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence apply. Courts in Wyoming will have exclusive jurisdiction, subject to those mandatory protections.
15. Changes to Terms
We may update these Terms. We will post the new version with an updated date. Material changes may be communicated in-product or by email when practical. Continued use after the effective date constitutes acceptance.
